With recent amendments to the Fair Work Act 2009 (Cth) now in effect, it’s essential for real estate agency owners and managers to ensure compliance with the latest workplace requirements.
Here’s a practical checklist, in true End of Month Angels style, to help you determine if your agency is meeting its new obligations:
1. Flexible Work Arrangements
- Have you updated your policies and processes for handling flexible work arrangement requests?
2. Casual to Permanent Employment
- Have you revised your procedures for responding to casual employees who request conversion to permanent roles?
- Have you issued Casual Employment Information Statements at the start of employment?
3. Right to Disconnect
- Have you reviewed your approach to work-related communications outside of working hours in line with the new right to disconnect?
4. Workplace Delegates
- Are your policies and practices updated to reflect the new rights of union and workplace delegates?
5. Family & Domestic Violence Protections
- Have you ensured that employees experiencing family or domestic violence are protected from adverse action and their confidentiality is maintained?
6. Fixed-Term Contracts
- Are you aware of the limitations on fixed-term contracts?
- Are you issuing Fixed Term Contract Statements when required?
7. Contractor Arrangements
- Do you understand the impact if a contractor opts out of section 15AA of the FW Act?
8. Pay Secrecy
- Have you reviewed and updated employment contracts to remove pay secrecy clauses. This is now no longer something we can keep in employment contracts or terminate employment over.
